In these terms 'we', 'us' and 'our' refers to MLC Limited ABN 90 000 000 402 AFSL 230694 trading as MLC Life Insurance and 'you' or 'your' refers to the individual accepting these terms. The provision of MLC Life Insurance’s Data Feed Service is subject to these terms and conditions as may be amended by us from time to time. By registering for the Data Feed Service, you accept and agree to these terms and conditions.

Provision of the Data Feed Service

If you select to participate in MLC Life Insurance’s Data Feed Service via our online Adviser Portal we will send to your selected third party (Third Party) client insurance and policy information by secure data transfer. You acknowledge that we may terminate or temporarily suspend your access to the Data Feed Service or our offer to provide Data Feed Services generally, at any time without cause. Without limiting this right to terminate or suspend the service, you acknowledge that we terminate or suspend your access to the Data Feed Service in the event that we are informed or reasonably believe that:

• you have had your Australian Financial Services Licence (AFSL) varied, suspended or cancelled
• you are otherwise no longer authorised to deal in or provide advice in relation to our products or
• you are no longer an authorised representative of your AFSL Licensee.

We will cease to provide the Data Feed Services to you in relation to a particular client if we are advised or reasonably believe that you are no longer the nominated servicing adviser to that client.

Availability and Interruption

At any time we may need to interrupt or suspend the Data Feed Services to perform maintenance on or generally review, investigate or resolve incidents or issues in relation to, MLC Life Insurance systems including the Data Feed Services or our Adviser Portal. MLC Life Insurance will have no liability to any person with respect to an interruption to or suspension of the service for any reason.

Sharing information with third parties

By registering for the Data Feed Service you are instructing us to share your client data with the selected Third Party. We take responsibility for the safe transmission of that data from our systems to the Third Party, however we are not responsible for the data or the actions of such Third Parties once the data is in their possession, including the security or use of that data. We may, upon your request, cease to provide data to the Third Party, however we cannot withdraw, and do not have control over, data that has already been provided.

We will not be liable for any loss you or your client(s) may incur as a result of the Third Party's use or misuse of information it receives from us.

If you or your client have any questions or concerns regarding the use or storage of the data by the Third Party, or wish to withdraw consent for the Third Party to hold the data, you or your client will need to contact the Third Party directly.

Client consent to share information

You warrant that you have obtained all necessary consents from your client(s), and any individuals who are the subject of personal information (as defined under the Privacy Act 1988 (Cth)) contained within the data, to share and allow us to share, data and information with the selected Third Parties through the Data Feed Services.

Accuracy of Information

We take reasonable care to ensure that the information for the Data Feed Services is accurate and up-to-date. However, our Data Feed Services do not occur in real time and subsequent changes in your or your client’s details or circumstances may impact on the accuracy of the information. MLC Life Insurance, its directors and employees do not provide any warranty, make any representation as to, or accept any responsibility for, the accuracy, reliability, timeliness or completeness of the information downloaded by this service. It is your responsibility to check the information downloaded to verify its accuracy.

Online Security

Access to MLC Life Insurance’s Adviser Portal on which you may subscribe or unsubscribe from the Data Feed Services is provisioned by the unique login credentials that we have provided to each Adviser. You should always keep your password and login details confidential.
